1. Acceptance of Terms

By accessing or using Clutch Deals (“the site”, “we”, “us”, “our”), including browsing, posting, commenting, voting, or creating an account, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, do not use the site. These Terms apply to all visitors, registered users, and contributors. We may update these Terms at any time — continued use of the site after changes are published constitutes acceptance of the revised Terms.

2. About Clutch Deals

Clutch Deals is a community deal-sharing and deal-aggregation platform for Australian consumers. Users and automated systems submit and surface deals, freebies, coupons, and bargains found across the web. We are not a retailer. We do not sell goods directly, take possession of any goods, process payments for goods, or act as an agent for any retailer.

Clutch Deals operates as a deal aggregation and community curation platform. Deals are submitted by community members or sourced automatically from publicly available retailer feeds, promotional data, and partner APIs. Our automated systems may apply AI-based quality scoring to deals, but this does not constitute a representation or warranty that any deal is legitimate, accurate, or currently available. Any transaction you make is directly between you and the relevant retailer — Clutch Deals is not a party to any such transaction.

Clutch Deals is operated by a private entity and is not affiliated with, endorsed by, or a partner of any retailer or brand whose products may appear on the site unless expressly stated.

3. User Accounts

• You must be 18 years or older to create an account (see also Section 6).
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• One account per person. Duplicate or shared accounts may be suspended without notice.
• You must provide a valid email address. We use it to send login codes and important notices only.
• You may not sell, transfer, or assign your account to another person.
• We reserve the right to suspend, restrict, or terminate accounts that violate these Terms at our sole discretion, without prior notice or liability.
• Content submitted by you may remain on the platform after your account is terminated or deleted. Deals, comments, and votes may be retained in an anonymised or attributed form for archival, community, and legal compliance purposes. If you wish to request removal of specific content, contact us at support@clutchdeals.com.au.

4. Posting Rules & Community Standards

All content submitted to Clutch Deals must comply with the following rules. Violations may result in content removal, account suspension, or a permanent ban. See also our Community Guidelines for detailed moderation standards.

• Deals must be genuine. Do not post expired deals, fake prices, or deals you have a commercial interest in without disclosure.
• No spam. Repeated posting of the same or substantially similar deals is prohibited.
• No undisclosed affiliate links. If you earn a commission from a posted link, you must disclose this in the deal description.
• No illegal content. Do not post deals for pirated goods, counterfeit products, illegal services, or anything that violates Australian law.
• No harassment. Treat other members with respect. Personal attacks, hate speech, and threatening behaviour will result in an immediate ban.
• No misinformation. Do not post deliberately false prices or misleading deal descriptions. We are not responsible for errors in user-submitted deal information, pricing, or availability — accuracy is the responsibility of the person posting the deal.
• Keep it relevant. Clutch Deals is for deals, freebies, and bargains available in Australia. Off-topic posts will be removed.
• No vote manipulation. Do not attempt to artificially inflate or deflate vote counts through the use of multiple accounts, automation, or coordinated groups.
• Age-restricted deals must be clearly labelled. Any deal for alcohol, tobacco, nicotine/vaping products, gambling credits, adult entertainment, or other age-restricted products must comply with Section 6 of these Terms.

We reserve the right to remove any content and take action against any account at our sole discretion.

5. Prohibited Uses

In addition to the community standards in Section 4, the following uses of the site are strictly prohibited:

• Automated access. You may not access, query, copy, or collect data from this site through any automated, programmatic, or non-human means, including web scrapers, robots, spiders, crawlers, data mining tools, browser automation tools, headless browsers, or any other automated process, without our prior written permission. This prohibition applies regardless of the technical method used or the stated purpose.
• Bulk data extraction. You may not use any automated tool or manual process to systematically extract, harvest, or compile deal data, user information, pricing data, or any other content from the site for use in competing services, commercial data products, or for any purpose other than personal use.
• Circumventing access controls. You may not attempt to bypass, circumvent, or defeat any security feature, rate limit, access control, CAPTCHA, or other protective measure on the site. Any attempt to probe, scan, or test the vulnerability of the site is prohibited.
• Misrepresenting identity. You may not impersonate any person or entity, misrepresent your affiliation with any person or entity, or use false headers or forged metadata to disguise the origin of any content or request.
• Interference. You may not transmit any virus, malware, or other malicious code, or interfere with, disrupt, or create an undue burden on the site's servers or networks.
• Commercial exploitation. You may not reproduce, mirror, frame, or commercially exploit the site's content, design, or functionality without our express written consent.

Breach of this section may expose you to civil liability and, where applicable, criminal liability under the Criminal Code Act 1995 (Cth) or other applicable legislation. We reserve the right to seek injunctive relief, damages, and/or costs in addition to any other remedies available.

6. Age-Restricted Content (Alcohol, Tobacco, Vaping & Gambling)

Alcohol

• Clutch Deals aggregates publicly available promotional information from licensed liquor retailers (including but not limited to Dan Murphy's, Liquorland, BWS, and Vintage Cellars). We do not sell alcohol, hold a liquor licence, or facilitate the purchase of alcohol.
• All alcohol-related content displayed on Clutch Deals is sourced from licensed retailers and is intended for adults aged 18 or over only.
• We comply with the ABAC Responsible Alcohol Marketing Code. Alcohol advertising is not targeted at minors. If you believe any content violates the ABAC Code, please report it to support@clutchdeals.com.au.
• Users must not submit alcohol deals intended to appeal primarily to persons under 18.
• The responsible service of alcohol is the responsibility of the licensed retailer, not Clutch Deals. Please drink responsibly. For support, contact DrinkWise or call the National Alcohol and Other Drug Hotline: 1800 250 015.

Tobacco & Vaping / Nicotine Products

• The advertising and promotion of tobacco products in Australia is prohibited under the Tobacco Advertising Prohibition Act 1992 (Cth). We do not knowingly publish or aggregate promotional content for tobacco products.
• Nicotine vaping products are regulated by the Therapeutic Goods Act 1989 (Cth) and state/territory laws. Deals for regulated vaping products will not be published on this platform.
• Users must not submit deals for tobacco products or illicit nicotine vaping products.

Gambling

• Clutch Deals does not knowingly aggregate or publish gambling promotional content (bonus bets, free bets, deposit match offers) where doing so would breach the Interactive Gambling Act 2001 (Cth) or relevant state legislation.
• Users must not submit deals for online gambling services, except where the promotion is from a licensed Australian wagering provider, is clearly labelled, and does not target persons under 18.

Other Age-Restricted Products

Deals for adult entertainment, adult novelty products, or other items legally restricted to adults must be clearly labelled and may only be submitted by registered users who confirm they are 18+. We reserve the right to remove any such deal at our sole discretion.

7. Health & Therapeutic Goods

• Clutch Deals aggregates publicly available promotional pricing from pharmacies and health retailers. We are not a healthcare provider, pharmacist, or medical adviser.
• Nothing on this site constitutes medical, pharmaceutical, or health advice. Always consult a qualified health professional before purchasing or using any therapeutic good.
• Deals for prescription medicines, controlled substances, or products classified as Schedule 3 or above under the Therapeutic Goods Act 1989 (Cth) will not be published.
• Deals for therapeutic goods (including supplements, over-the-counter medicines, medical devices) are sourced from licensed retailers and are subject to TGA advertising standards. We do not make therapeutic claims about any product.
• Users must not submit deals that make false or misleading therapeutic claims, or that relate to products requiring a prescription.

8. Voting & Rankings

Votes reflect community opinion and are used to rank deals. You may not attempt to manipulate votes, rankings, or the Gold system through automation, coordinated behaviour, or multiple accounts. We may adjust or remove votes at our discretion if manipulation is detected. Voting data may be used to personalise your feed and improve deal quality scores.

9. Gold System

Gold is a virtual recognition system with no monetary value unless otherwise expressly stated. It cannot be exchanged for cash or transferred between accounts. We may modify Gold earn rates, level thresholds, or perks at any time, or discontinue the Gold system entirely, without notice or compensation. Gold earned does not create any contractual entitlement.

Any paid Gold features (if introduced) are subject to our refund policy and any non-excludable consumer guarantees under Australian Consumer Law.

10. Intellectual Property & Content Licence

By submitting content to Clutch Deals (deals, comments, descriptions, images), you grant us a non-exclusive, royalty-free, worldwide, perpetual, sublicensable licence to display, reproduce, distribute, adapt, and promote that content on the site, in digest emails, social media channels, and in marketing materials. You retain ownership of your original content.

You represent and warrant that: (a) you have the right to post the content; (b) the content does not infringe any third-party intellectual property rights; and (c) the content does not violate any law or these Terms. Deal prices and basic product information are factual and are not claimed as our intellectual property. Retailer-owned product images remain the property of their respective owners; we display them under fair dealing or with permission from the relevant retailer.

The Clutch Deals name, logo, and site design are our intellectual property. You may not reproduce, copy, or imitate them without our written permission.

Automated access and scraping is prohibited — see Section 5. You may not scrape, mirror, frame, or commercially reproduce the content of this site without our prior written consent.

If you believe your copyrighted material has been posted on Clutch Deals without authorisation, please contact us at support@clutchdeals.com.au with details of the claimed infringement. We will investigate and respond within 5 business days.

11. Third-Party Links, Retailers & Marketplace Model

Clutch Deals is a deal aggregation platform, not a retailer or marketplace operator. We surface deals and link to third-party retailer websites. Any purchase you make is a transaction solely between you and the relevant retailer. Clutch Deals is not a party to any such transaction and accepts no responsibility for:

• The accuracy, completeness, or legality of any retailer's listing, product description, or pricing
• Product availability, stock levels, or fulfilment
• Delivery, returns, refunds, or after-sales service
• The retailer's privacy practices or terms of sale
• Any loss, damage, or dispute arising from a transaction with a retailer

Prices and availability shown on Clutch Deals are sourced automatically and may not reflect the current price at the retailer at the time you click through. Deal prices can change without notice. Always confirm the price and availability directly on the retailer's website before purchasing.

User-submitted deals are not verified by us. We do not warrant the accuracy, completeness, or currency of any deal submitted by a community member. The person who submitted the deal is solely responsible for its accuracy. We expressly disclaim any liability for losses arising from reliance on user-submitted deal information.

The inclusion of a link to a retailer does not imply our endorsement of that retailer. Some links may be affiliate links. See our Affiliate Disclosure for full details.

12. Disclaimers & Limitation of Liability

Clutch Deals is provided “as is” and “as available” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

We make no warranty regarding the accuracy of deal information. Deal prices, discount percentages, product specifications, and availability are sourced from retailers and community members and may be incorrect, outdated, or unavailable at the time you access them. User-submitted deal ratings, comments, and price history are opinions and are not verified. We expressly disclaim liability for any decision made in reliance on deal information on this site.

We are not responsible for any loss or damage arising from:

• Reliance on any deal, price, availability, or product information on the site
• Purchases made through links on the site, including disputes with retailers
• User-submitted content (inaccurate deals, misleading descriptions, fraudulent posts)
• Temporary or permanent unavailability of the site or any deal link
• Unauthorised access to or alteration of your account
• Age-restricted products obtained by minors who misrepresented their age
• Actions taken by our automated deal-scoring or moderation systems

To the maximum extent permitted by law, our total aggregate liability to you for any and all claims arising from your use of the site is limited to AUD $100 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law(Schedule 2 of the Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited, including non-excludable consumer guarantees where applicable.

13. Indemnification

You agree to indemnify, defend, and hold harmless Clutch Deals and its operators, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the site; (b) your violation of these Terms; (c) any content you submit, including inaccurate, misleading, or unlawful deals or comments; (d) your violation of any applicable law or the rights of any third party; (e) any age-restricted content you access in breach of these Terms; or (f) any transaction between you and a retailer linked from the site.

14. Privacy

Your use of Clutch Deals is also governed by our Privacy Policy. We collect limited personal data (email address, posting activity) to provide the service. We do not sell your personal data. Refer to the Privacy Policy for full details.

15. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page. Material changes will be communicated via a site notice or email where practicable. Your continued use of Clutch Deals after revised Terms are posted constitutes your acceptance of those Terms. If you do not agree to the revised Terms, you must stop using the site.

16. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law provisions.

Before commencing any legal proceedings, you agree to first contact us at support@clutchdeals.com.au and allow 30 days for us to attempt to resolve the dispute in good faith.

Any dispute not resolved informally will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
